The Probate Process

The probate process in Florida is a court-supervised process designed to settle a deceased person’s estate. The process begins with the filing of a petition with the court, which names a personal representative who will be responsible for administering the estate. The personal representative is responsible for notifying heirs and creditors of the estate and collecting and distributing assets. The personal representative must also file necessary tax returns and account for all of the assets and liabilities of the estate. Once all of the assets and liabilities of the estate have been accounted for, the personal representative will file a final report with the court. The court will then approve the report and close the estate.

In Florida, a Personal Representative (also known as an Executor) is responsible for managing and settling a decedent’s estate during probate. Their duties include filing the will, identifying and gathering assets, paying debts and taxes, and distributing the remaining assets to beneficiaries. They must act in the best interest of the estate and follow Florida law. A Personal Representative must be at least 18 years old, and while they can be out of state, they may need a local agent for service.

The probate process in Florida addresses the legal steps required to administer a deceased person’s estate. It involves validating the will (if there is one), identifying and gathering assets, paying debts and taxes, and distributing the remaining assets to beneficiaries. The probate system is strictly a civil process and does not address any criminal matters. Additionally, the probate system does not address any issues related to family law, such as divorce or child custody. These matters must be handled separately.
